1. About these terms
These terms apply when you purchase goods or services from Kennect Australia through our website or another sales channel. By placing an order, you agree to these terms to the extent permitted by law.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law (ACL) or other applicable law.
2. Product and service information
We take reasonable care to describe products, availability, specifications and services accurately. Images may be illustrative and minor product details may change where manufacturers revise models. If a material error affects an order, we will contact you and provide an appropriate option, which may include correction, substitution with your agreement, or cancellation and refund.
3. Prices and payment
Prices are shown in Australian dollars unless stated otherwise. GST treatment will be displayed where applicable. You must pay the amount shown at checkout, including any disclosed delivery or other charges. Orders may be subject to payment authorisation and fraud/security checks.
4. Order acceptance and availability
An automated order acknowledgement does not necessarily mean we have accepted an order. Acceptance occurs when we confirm supply or commence fulfilment. If an item is unavailable, incorrectly priced, or cannot reasonably be supplied, we will contact you and may cancel the affected item and refund amounts paid for it.
5. Delivery
Delivery estimates are estimates unless we expressly agree to a guaranteed timeframe. We will take reasonable steps to supply within any agreed time, or otherwise within a reasonable time. See our Shipping & Delivery Policy for further information.
6. Consumer guarantees, faults and remedies
Goods and services supplied to consumers come with statutory consumer guarantees. If a product or service fails to meet a consumer guarantee, remedies may include repair, replacement, refund, cancellation, re-performance of services or compensation depending on the circumstances and whether the failure is major or minor.
We may assess a product or service to determine the nature of a reported problem before providing a remedy where the law permits. We will not require you to deal only with a manufacturer where Kennect, as the seller, has obligations under the ACL.
7. Change of mind
Australian Consumer Law generally does not require a business to provide a refund or exchange simply because a customer changed their mind, ordered the wrong item, found a cheaper price elsewhere, or no longer wants the item. Any voluntary change-of-mind return we agree to is additional to, and does not limit, your statutory rights. See our Returns & Refunds Policy.
8. Services and repair work
Technical and repair services are also subject to applicable consumer guarantees, including guarantees relating to due care and skill, fitness for disclosed purpose, and completion within a reasonable time where no time is agreed. Additional service conditions are set out in our Service Terms.
9. Accounts and website use
You are responsible for keeping account credentials secure and for information submitted using your account. Do not misuse the website, interfere with its operation, attempt unauthorised access, or use it for unlawful purposes.
10. Liability
To the maximum extent permitted by law, Kennect is not liable for losses that are remote, unforeseeable or caused by matters outside our reasonable control. This clause does not limit liability or remedies that cannot lawfully be limited, including applicable ACL rights.
11. Governing law
These terms are governed by the laws applicable in South Australia and Australia. Nothing in this clause removes any right you may have to bring a claim in another jurisdiction where applicable law permits.
